Litigation Funding: The Uncorrelated Asset Class

Investors regularly face uncertainty and challenging market environments. Traditional portfolios remain volatile during these times and diversification into alternative asset classes is now more mainstream amongst investors.

Litigation funding is one of the most attractive alternative investments and is a fast-growing asset class that is still widely overlooked by investors. This niche area has proven to be recession-proof and offers true uncorrelated returns. 


Litigation funding is a financing facility where a third party - a litigation funding firm - provides the financial resources to support a claimant in a legal dispute for an agreed  share of the returns. Managing the Risk of Litigation

When a Claimant files a claim, the claimant is obligated to purchase a policy of After The Event Insurance, known as ‘ATE insurance’. This policy covers the Defendant’s costs and disbursements, as well as the claimants own disbursements. If a claim is unsuccessful, then the funders capital will be secure under the ATE insurance policy. Our funders benefit from comprehensive downside protection through the assignment, with full title guarantee, of the rights in each policy of ATE, along with the benefits and rights in each claim.

Funding funding specialises across precedent led consumer litigation claims and exclusively for our law firm partner; growth in 2024 will come from funding new areas of consumer litigation. Based in Berkeley Square, Mayfair, London; Christopher also works across the international regions of the UAE and Switzerland.


Christopher’s key role within CWC is manifold; to raise capital for the funding of claims in litigation, working exclusively with and alongside full legal counsel; performing investment analysis, models and valuation to mitigate risk; and to expand the businesses network of Strategic Partners across new geographical regions.


As Consultant Director; Chris defines and oversees the capital function at CWC and works across investor relations whilst working closely with professional investors and strategic partners defining capital terms and funding structures. His qualifications include BSc., attaining Series 65 and IMC; and is a member of the Institute of Consulting (MIC), a division of the Chartered Management Institute (ChMg).
